Judge Chris Carnahan: Arkansas Supreme Court to alter pretrial release rules
Little Rock, Arkansas – Judge Chris Carnahan is calling for the Arkansas Supreme Court to issue a change to the Arkansas Rules of Criminal Procedure Rule 18.5 regarding the release of defendants accused of crimes of violence.
When weighing whether they should be released on bail, the rule forbids judges from considering the likelihood of a defendant reoffending.
According to Judge Carnahan, this runs afoul of federal pretrial release rules, that allow judges to take into account all relevant factors before making such a decision.
Judge Carnahan is a candidate for the Arkansas Supreme Court.
According to Carnahan, if elected he will advocate for this change.
Carnahan is the Ninth State District Judge from Conway.
Previously, he served as Senior Deputy Prosecutor for the 20th Judicial District.
